Terms of Use

IMPORTANT: IF YOU LIVE IN THE UNITED STATES, SECTION 16 CONTAINS A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION AND JURY TRIAL WAIVER. IT AFFECTS HOW DISPUTES BETWEEN YOU AND THE WELL ARE RESOLVED. PLEASE READ IT.

Welcome to The Well. These Terms of Use ("Terms") are a legal agreement between you and Look Up The Stars Astrology Services Inc. ("The Well," "we," or "us") regarding your use of the The Well website, mobile application, and any related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. The Service

The Well is an astrology app. It computes your natal chart from birth details you provide and surfaces interpretations across several areas: your placements organised into six dimensions (Identity, Mind, Emotions, Relationships, Drive, Purpose), short-term and deeper-cycle transits, lunations and eclipses, monthly themes and notable dates ("Year Planner"), reflective exercises ("Your Practice"), and emerging patterns ("Hidden Traits"). The birth-chart, transit, daily energy, and lunar-cycle text, and the Year Planner titles, are written by a human astrologer; the personalisation layers (the "For You" readings, the "in a nutshell" summaries, the personalised lunation reveals and hidden-trait readings, and the practice exercises) are generated by AI, as described in our Privacy Policy.

The Service is for entertainment and self-reflection purposes only. It is not a substitute for professional medical, psychological, legal, financial, or other advice. Nothing in the Service is a prediction, diagnosis, or treatment.

 

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

 

3. Your account

You're responsible for the accuracy of the information you give us, for keeping your sign-in credentials safe, and for activity that occurs under your account. Tell us promptly if you suspect unauthorized use. We may suspend or terminate accounts that we reasonably believe violate these Terms or applicable law.

 

4. License to use the app

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use The Well on devices you own or control, for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract source code from the app, except where applicable law prohibits this restriction.

 

5. Your content

You may save reflections, bookmarks, and other notes inside The Well, and you may add other people as connections by entering their birth details ("Your Content").

You retain ownership of Your Content. You grant us a worldwide, royalty-free license to host, store, and display Your Content solely for the purpose of operating and improving the Service for you. We do not use Your Content for advertising, do not share it with other users, and do not use it to train AI models.

When you add a connection, you confirm that you have the right to use that person's birth details for the purpose of viewing them inside The Well. The Well connections are private to your account.

 

6. Acceptable use

You agree not to:

  • Use the Service in any way that violates applicable law.

  • Attempt to access another user's account, scrape, data-mine, or systematically retrieve data from the Service.

  • Reverse-engineer, decompile, disassemble, or interfere with the Service's operation, or probe its security.

  • Use the Service to harass, defame, or harm others, or to transmit unlawful, infringing, or hateful content.

  • Impersonate any person or misrepresent your affiliation.

  • Use the Service's AI-generated content to make high-stakes decisions, including medical, legal, financial, or safety-related ones.

 

7. AI-generated content

The birth-chart text in the placement cards, the transit and deeper-cycle text, the daily energy text, the lunar-cycle text, and the Year Planner titles are written by a human astrologer. The personalisation layers (the "For You" premium readings inside cycles, the "in a nutshell" summaries, the "Personalised for you" lunation reveals, the hidden-trait readings, the practice exercises, and pattern reactivation messages) are generated by AI, as detailed in our Privacy Policy. AI output may be inaccurate, incomplete, or misleading. Treat it as commentary, not fact. We do not guarantee the accuracy of any AI-generated reading.

 

8. Subscriptions and purchases

The Well offers a free tier and Premium subscription tiers (currently monthly, three-month, six-month, and yearly). The yearly tier additionally unlocks the Year Planner. The free tier includes the core chart and base interpretations; Premium tiers unlock personalised cycle readings, lunations and eclipses tuned to your chart, expanded connections, time travel, hidden traits, and a higher cap on practice exercises.

Subscriptions are processed through the Apple App Store or the relevant platform's billing system. They auto-renew unless cancelled before the end of the current period, and prices, billing terms, and renewal rules are presented to you at the point of purchase. Refunds for platform-billed purchases are governed by the platform's policies; we are not able to issue refunds for purchases made through Apple.

 

One-time question unlocks. Some Year Planner questions can be unlocked individually for a one-time price instead of a yearly subscription. A one-time unlock covers one question and produces a reading anchored to your purchase date: it covers the twelve months from purchase and stays viewable through that period. At the start of the month after that covered year ends, the reading locks again. A one-time unlock is not a subscription and never renews by itself; you may purchase the same question again after it locks. One-time unlocks are processed through the App Store and refunds are governed by Apple's policies.

Referral rewards. Inviting a friend can add one extra connection slot to your free account (up to four bonus slots) when they sign up through your invite link. Referral rewards have no cash value, are not transferable, and may be adjusted, revoked in cases of abuse (for example self-invites or duplicate accounts), or discontinued. Slots you have already earned and filled are not removed.

9. Intellectual property

The Service, including the app, the written interpretations, the visual design, the names and branding "The Well Astrology" and "Look Up The Stars," and all software, are owned by Look Up The Stars Astrology Services Inc. or its licensors, and are protected by intellectual-property laws. Except for the limited license in Section 4, nothing in these Terms transfers any of those rights to you.

 

10. Feedback

If you send us suggestions, ideas, or feedback, you grant us the right to use that feedback freely and without obligation. You won't be entitled to compensation for it.

 

11. Apple App Store terms

If you obtain The Well through the Apple App Store, you acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support, and Apple is not responsible for any product warranties, claims, or product-liability matters relating to the Service. Apple is a third-party beneficiary of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S.

Government list of prohibited or restricted parties.

 

12. Modifications and termination

We may modify, suspend, or discontinue the Service (or any part of it) at any time. We may also update these Terms; if we make a meaningful change, we'll notify you in the app and update the "Last updated" date. Your continued use of the Service after a change means you accept the updated Terms.

You may stop using the Service at any time and delete your account directly from Settings inside the app, or by emailing us. We may suspend or terminate your access if you violate these Terms or use the Service in a way that puts others at risk.

 

13. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY READING OR SUMMARY WILL BE ACCURATE.

 

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WELL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50. THESE EXCLUSIONS AND THIS CAP APPLY WHETHER A CLAIM IS BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF STATUTORY DUTY, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow these limitations; in those places our liability is limited to the smallest amount permitted by law.

 

15. Indemnification

You agree to defend and indemnify The Well from any claims, damages, or expenses (including reasonable legal fees) arising out of: (a) your use of the Service in breach of these Terms; (b) Your Content; or (c) your violation of any law or third-party right.

To the fullest extent permitted by law, you release The Well and its officers, directors, employees, and agents from claims of every kind, known or unknown, arising out of or relating to disputes between you and any third party in connection with the Service. Where the law of your jurisdiction limits the effect of a general release, this release applies only to the extent permitted.

 

16. Governing law and disputes

Governing law. These Terms are governed by the laws of the Province of British Columbia, Canada, and the federal laws of Canada applicable there, without regard to conflict-of-laws rules.

Talk to us first. Before starting any formal proceeding, you agree to contact us at the email below with a written description of the dispute and give us sixty (60) days to resolve it informally. We will do the same before starting any proceeding against you. Most concerns can be resolved this way.

If you live in the United States: binding individual arbitration. Any dispute arising out of or relating to these Terms or the Service that we cannot resolve informally will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. Either of us may instead bring an individual claim in small claims court if it qualifies there. The arbitration will be conducted in English by videoconference, telephone, or written submissions, or, if an in-person hearing is required, in the county where you live. Other than your AAA filing fee, The Well will pay the AAA administrative and arbitrator fees for consumer claims. Judgment on the award may be entered in any court with jurisdiction, and either party may ask a court for provisional relief in aid of arbitration.

CLASS ACTION AND JURY WAIVER: IF YOU LIVE IN THE UNITED STATES, YOU AND THE WELL EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. DISPUTES MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY. If this class action waiver is found unenforceable as to a particular dispute, then the arbitration provisions above will not apply to that dispute, and it will be resolved in the courts described below.

Everywhere else, including Canada. If the arbitration provisions above do not apply to you or to a particular dispute, the dispute will be brought in the courts located in Vancouver, British Columbia, and you and The Well consent to the exclusive jurisdiction of those courts.

Your local rights. Where the consumer protection law of your home jurisdiction gives you the right to bring a claim in your local courts, in your local language, or under your local law, nothing in these Terms takes that right away. Nothing in these Terms limits rights that cannot be limited by contract.

Time to bring claims. To the maximum extent permitted by applicable law, any claim relating to the Service must be started within one (1) year after the events giving rise to it. Where applicable law does not permit that limit, the shortest period permitted by law applies.

 

17. General

If any provision of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.
